Chief Justice should respect his position, authority: Shazia Marri

Canada Global (Web News) Shazia Marri, the leader of the Pakistan Peoples Party (PPP), lambasted the Chief Justice of Pakistan on Tuesday during a National Assembly session, asserting that the Supreme Court cannot interfere with the authority of the Parliament.

She made it clear that the government had come to support Parliament rather than engage in combat.

Ms. Marri claimed that as a member of the Parliament, she was in charge of safeguarding the Pakistani constitution.

The son of the late Chief Justice Saqib Nisar was heard in recent audio leaks talking about collecting money in his father’s name. Ms. Marri also discussed this.

She raised worries about what the same son might have done while his father was chief justice and questioned how a former chief justice could permit such behaviour.

She urged the Pakistani chief justice to uphold his power and position.

Chinese foreign minister to arrive in Pakistan on maiden visit on Friday

Canada Global (Web News) Later this week, Chinese Foreign Minister Qin Gang will travel to Pakistan for the first time since taking office.

According to sources, Mr. Gang would arrive in Islamabad on May 5 just after the SCO Foreign Ministers’ Meeting 2023 in the Indian state of Goa. On May 6, he would visit Pakistan and undertake strategic consultations with government representatives.

To discuss the situation in the region, Pakistan, China, and Afghanistan are also anticipated to meet in a trilateral setting. Amir Khan Muttaqi, the interim Afghan foreign minister, would attend the meeting in Islamabad.

Amir Khan Muttaqi, the foreign minister for the Taliban government, was earlier given permission by a UN Security Council committee on Monday to fly from Afghanistan to Pakistan the following week in order to meet with the foreign ministers of Pakistan and China, according to diplomats.

Under Security Council sanctions, Muttaqi has long been subject to a travel ban, asset freeze, and arms embargo.
Pakistan’s U.N. mission requested an exception for Muttaqi to travel between May 6 and 9, “for a meeting with the foreign ministers of Pakistan and China,” in a letter to the Security Council’s 15-member committee on Taliban sanctions.

Chinese and Pakistani officials have both previously declared that they would welcome a Taliban-led Afghanistan as part of the multibillion dollar China-Pakistan Economic Corridor (CPEC) infrastructure project, which is a component of the Belt and Road Initiative.

Afghanistan is strategically situated on a trade and transit corridor connecting South and Central Asia, and it has untapped natural resources worth billions of dollars. The U.S.-led force left Afghanistan in August 2021 after 20 years of fighting, allowing the Taliban to take over.

Last month, a gathering of Afghanistan’s neighbours’ foreign ministers took held in Uzbekistan, and Muttaqi was given authorization by the Security Council committee to go. The purpose of the gathering was to discuss important matters of stability, security, and peace.

Pakistan’s govt again sends judicial reforms bill to President Alvi for assent

Canada Global (Web News) The Supreme Court (Practice and Procedure) Bill, 2023, was approved in a joint session of parliament, and the federal government sent it back to President Arif Alvi on Tuesday for his signature.

The purpose of the bill is to limit the chief justice of Pakistan’s ability to take suo motu notice in accordance with clause (3) of Article 184 of the Constitution. A three-member committee made up of senior judges, including the chief justice, will have the authority to take suo motu notice if the measure is signed into law by the president.

Additionally, it states that any matter involving the exercise of original jurisdiction under clause (3) of Article 184 of the Constitution must first be brought before the committee for review. If the committee determines that the matter involves the enforcement of one or more fundamental rights, it must then establish a bench consisting of at least three judges of the supreme court, which may also include committee members.

In accordance with the Constitution, assent is presumed to have been provided if the President fails to sign the law within 10 days.

The bill was introduced a day earlier by Federal Law Minister Azam Nazir Tarar in the joint session of parliament for reexamination in light of the president’s letter.

Speaking at the event, the minister claimed that the opposition had displayed ignorance regarding the subject and claimed that the president had made a disparaging remark about the power of the house to pass laws. He said, “Mr. Alvi ought to have prevented this.”

The measure “prima-facie travels outside the competence of the Parliament and can be assailed as a colorable legislation,” according to President Alvi, who had sent the bill back to parliament for reconsideration on April 8.

Parliament again passes bill curtailing CJP’s authority

Canada Global (Web News) The Supreme Court (Practice and Procedure) Bill 2023 was once again approved by a joint session of parliament on Monday, much to the chagrin of the opposition.

The bill, introduced by federal law minister Azam Nazir Tarar, would be brought back to President Dr. Arif Alvi for approval after he had previously sent it back to the legislature unsigned.

The minister claimed that the opposition had displayed ignorance on the subject and added that the president had made a disparaging remark about the power of the house to pass laws. He said, “Mr. Alvi ought to have prevented this.”

The law, according to Mr. Tarar, was passed to counteract the effects of the “one man show,” and all authority was given to two SC judges. He continued, “If an amendment has been presented, it must be considered.” He claimed that we sought judicial system transparency.

He cited Senator Mushtaq Ahmad’s heated speech and said he was against the revisions that Mr. Ahmad had suggested.

A meeting of the judges’ committee would be held after Shiza Fatima of the PML-amendment N’s to the bill was approved by the parliament. Until rules were developed, CJP Bandial or any other judge’s committee member could call the meeting.

  • Govt wants controversial Chief Justice Bandial’s resignation

Govt wants controversial Chief Justice Bandial’s resignation

Canada Global (Web News) The government asked Chief Justice Umar Ata Bandial’s resignation on Friday, one day after the PDM-led federal government issued a resolution opposing the Supreme Court’s (SC) decision mandating elections in Punjab on May 14.

In a confrontational press conference on Friday, the Federal Minister of Information, Marriyum Aurangzeb, sought the resignation of Chief Judge Umar Ata Bandial, asserting that the recent case was not about elections but rather bench fixing.

She also lambasted the judges and called Imran Khan, the leader of the Pakistan Tehreek-e-Insaf (PTI), a crook and a favourite of the courts.

Judge Athar Minallah’s dissenting note, according to Ms. Aurangzeb, casts doubt on the legitimacy of court procedures. If judicial proceedings are viewed as contentious, how can the public accept the court’s rulings?

According to her, the petition was rejected and the bench could not have been constituted based on it.

She said that the contentious bench was established in response to a petition that the majority judges had rejected, and Justice Minallah’s dissenting note claims that the suo motu notice was what set off the issue.

The federal minister continued to attack the judges while citing earlier rulings.

She claimed that whereas Chaudhry Shujaat’s letter was deemed unlawful, Imran Khan’s letter was upheld by the court.

She claimed that this drama was based on a forged cypher and that the inspiration came from the case of the transfer of the Lahore CCPO.

Ms Aurangzeb pointed out a contradiction in the Supreme Court’s decision, stating that the court ordered elections in Punjab but did not apply the 90-day rule in Khyber Pakhtunkhwa.

She claimed that the court did not hear political parties and that only one party’s (PTI) stance was heard repeatedly.

She questioned why other political parties were not heard, and if the PTI was the only party that ran for office.

Marriyum Aurangzeb argued that the constitution and truth had triumphed over ‘Imran-daari,’ and that the truthful judges had exposed Imran’s facilitation.

She further asserted that following Justice Athar Minullah’s ruling, the majority judges’ ruling was final, and the election commission’s duty was to conduct elections.

It’s now obvious that Imran Khan was being helped, she said. “The parliament ruled against having a divisive bench. The four judges who made up the majority of the court pushed for the formation of a full court, and Judge Athar Minullah agreed today.

The chief justice’s post had become contentious, according to the federal minister, who demanded his resignation.

Maryam Nawaz wants PM Shehbaz disqualified, claims Fawad Chaudhry

Canada Global (Web News) Fawad Chaudhry, a senior leader of the Pakistan Tehreek-e-Insaf (PTI), asserted on Thursday that Maryam Nawaz Sharif, senior vice president of the Pakistan Muslim League-Nawaz (PML-N), desired the disqualification of Prime Minister Shehbaz Sharif.

Speaking at a news conference, Mr. Chaudhry blasted the current administration for introducing the motion in the National Assembly that was meant to overturn the Supreme Court’s (SC) decision. He claimed that by doing so, the outcome would remain unchanged.

Mr. Chaudhry criticised the coalition administration for “not being willing to contest elections,” stating that the constitution required elections to be held within 90 days after the assembly’s dissolution. Yet, the government disregards the nation’s constitution. The ruling class believes that voting rights should be abolished.

He emphasised the importance of escaping the political unrest in an effort to resolve the economic problems.

The PTI stalwart took a jab at PML-N supremo Nawaz Sharif and asked him “to restore the national money” and then relocated wherever he wished.

According to sources, the ECP would review the Supreme Court’s judgement and provide a legal update to the commission’s meeting about the May 14 elections.

Manitoba Opposition to delay bill that would license some addiction centres

Canada Global (Web News) The supervised drug consumption sites and some other addiction treatment facilities would need to be licenced, according to a measure that the opposition New Democrats in Manitoba say they intend to postpone from being passed.

The NDP has selected Bill 33 as its first item this year under the Opposition’s ability to delay up to five bills in the legislature until the fall each spring.

Given that an election is slated for October 3, the delay means that the bill may never become law.

The law was submitted by the Progressive Conservative administration last month.

Standards of care would be established, minimal levels of medical supervision would be necessary, and offenders would be subject to fines of up to $50,000 per day.

The law, according to the New Democrats, appears to be intended as a barrier for organisations like Sunshine House, which has been granted a federal exemption to run a mobile overdose prevention van in the heart of Winnipeg.
